This is also because it increases the value of the property. If you want to rent out your property, you must apply for a licence from the Balearic Government's Ministry of Tourism. It is still not easy to obtain a licence and it requires a lot of patience due to the many special regulations and the limited number of licences issued.
The property must be located in an area where renting is permitted according to the zoning plan. A corresponding certificate must be applied for from the local authority where the property is located. If it is a flat in a multi-family house, the owners' meeting must first agree to the rental. Renting is only permitted with the registration number issued. Fines of €20,000 to €40,000 are imposed for tourist rentals and marketing of properties in Mallorca without a valid holiday rental licence.
Certain conditions must be met in order to be allowed to rent out the property: The property must have been privately owned for at least five years and must not be social housing. In addition, it must have a certificate of habitability (Cédula de habitabilidad) and a certificate of energy efficiency.
If your property is located in an apartment building, it must have individual water and electricity meters. There must be at least one bathroom for every four guest beds. The total number of properties that can be rented out per owner is limited to three.
If the requirements for a licence are met, the landlord can purchase tourist places on the Mallorcan guest bed exchange. However, each guest bed in the property is calculated individually. Finally, the ‘Declaration of Commencement of Tourist Activity’ must be submitted to the Directorate General for Tourism in the Ministry of Tourism. This can be applied for and completed directly at the Ministry or downloaded directly from the website.
The zoning plan divides the island into different areas. On the one hand, there are the ‘non-saturated’ tourist areas, where renting is generally permitted. In “saturated” coastal communities, renting is only permitted under certain conditions. The same applies to ‘fragile’ areas in the interior of the island. Special regulations apply to rural areas, which are also divided into different categories with stricter and less strict requirements.
